The appeal filed by Tej Pal is dismissed for lack of merit.
Summary
The case involves Tej Pal, who was convicted of murder under IPC sections 302 and 149 arising from a land dispute, and sentenced to life imprisonment. Tej Pal appealed the conviction before the Supreme Court, while a separate Special Leave Petition (SLP) filed by co-accused Narendra had already been dismissed. The Court examined whether the appeal by Tej Pal could be entertained in light of the earlier dismissal of the SLP. It found no merit in Tej Pal's appeal and noted that the earlier dismissal of the SLP precludes further relief. Consequently, the Court dismissed the appeal for lack of merit. The judgment reaffirms the conviction and the life sentence imposed by the lower courts.
Issues considered
- Whether the appeal filed by Tej Pal is maintainable after the dismissal of the Special Leave Petition filed by co-accused Narendra.
- Whether there is any substantive merit to set aside the conviction and life imprisonment under IPC sections 302 and 149.
